Welcome to the Cubbley Heart Privacy Policy (“Policy”). This document outlines how we collect, store, safeguard, and share your information, as well as the parties with whom we share it. We recommend reading this Policy alongside our Terms and Conditions of Use.
While using the Cubbley Heart mobile application (including the desktop version) (“App”), our websites, and microsites (such as cubbleyheart.com), or engaging with our digital products and services (including competitions or surveys) (collectively referred to in this Privacy Policy as our “Sites”), we gather certain information about you. Additionally, you may choose to share information with other users, such as your friends and contacts (“Users”). In some cases, we may also need to share your information.
As Cubbley Heart operates globally, your information may be transferred and used in Malaysia, regardless of your location. This Policy details how we protect your personal data during international transfers, so please review it carefully!
Who we are
The App and Sites are managed by the “Cubbley Heart Group” (also referred to in this policy as “we” or “us”), which includes Tshuan Technology Enterprise. These entities are all controllers of personal information collected and processed through the Cubbley Heart App and Sites.
1. COLLECTION OF INFORMATION
Registration Information
When you download the App and create an account (“Account”), we may collect certain information (“Registration Information”) about you, such as:
Name
Username
Email address
Mobile number
Gender identity
Date, time, and location of birth
Sexual preference
Photographs
Location
Once you’ve registered, you can review and modify this information at any time by logging into Cubbley Heart (except for your date of birth and location, which may automatically update based on the location of your device if you’ve granted Cubbley Heart access to your device’s location). It’s your responsibility to keep your account details up to date. If your phone number changes, please make sure to update it in your account.
The information we collect helps to improve the App and ensure our Users are legitimate (we don’t allow robots). Registration Information such as your sexual preference, name, and username may be visible to other Users who view your profile page.
Profile Information
We encourage you to be thoughtful about the information you share. We recommend that you avoid sharing sensitive details like email addresses, URLs, instant messaging info, phone numbers, full names or addresses, credit card information, national identity numbers, driver’s license details, or any other sensitive data that could be misused or abused on your profile.
When you post information about yourself or use the messaging function to communicate with other Users, the amount of personal information you share is at your own risk. Please refer to Section 4 below for more information about who can access what you post on Cubbley Heart.
Profile Verification Information (Including Biometric Information)
To ensure your safety and provide the best user experience, we require users to verify their accounts. This may involve providing your email address and/or phone number and, in some cases, completing a photo verification. We want to confirm that you are a real person and prevent the creation of fake Cubbley Heart accounts that could be used for malicious activities or cybercrime, which could harm the Cubbley Heart community. This verification process may also be necessary to help prevent fraud. Additionally, you can voluntarily verify your photo.
If you choose to verify your photo, we will scan each image you submit. This scan may include facial recognition technology to compare the photo with your profile image, ensuring that you are who you claim to be. We do not display the verification photos on your profile. We will store the scans for future verification and record-keeping purposes until they are no longer needed or for three years following your last interaction with us, whichever comes first. After this retention period ends, we will securely delete the scans from our systems.
Purchases Information
If you decide to purchase any premium services, we will securely process and store your payment information for fraud prevention, as well as for audit and tax purposes. Cubbley Heart uses automated systems to detect and prevent fraudulent transactions as part of its anti-fraud measures. Our systems assess payment transactions for patterns that suggest a violation of our Terms and Conditions of Use. If a transaction appears likely to breach these terms and is flagged as potentially fraudulent, it may be automatically blocked. If this happens, you will be notified that the transaction cannot be processed, and you can contact Cubbley Heart to dispute the decision.
Please note, if your account is blocked for any reason, any accounts you have on other Cubbley Heart Group platforms or apps, may also be blocked as part of our anti-spam and anti-fraud procedures.
Geolocation Information
If you have allowed Cubbley Heart to access your location through your device settings, we will collect details about nearby WiFi networks and other location data such as your longitude and latitude while using the app. We may also store your device’s coordinates to provide specific features. This data helps us determine your physical location, enabling us to customize the app experience by showing your general area to others and displaying profiles of users nearby.
Device and Photos Information
When you use the app, we may gather information about your device, including its unique identifier, model, and operating system, for various purposes outlined in this policy. Additionally, if you allow us, the app may access your device’s address book to help you add contacts.
Links
We may monitor how you engage with links within the app, including those leading to third-party services, by tracking clicks or using other methods. We might share aggregated statistics about link interactions, such as the number of times a specific link was clicked.
Cubbley Heart Success Stories, Surveys, and Other Contributions
Occasionally, we conduct surveys for research purposes and may reach out to ask if you’d like to participate. We may also contact you to request feedback, testimonials, or your involvement in marketing campaigns. For example, if you share that you’ve found a match on the app, we might ask if you’re willing to be featured in our advertising. Participation in surveys and marketing campaigns is entirely optional, and we’ll provide further details when we reach out. If you prefer not to be contacted for surveys or marketing campaigns, you can reach out to our Customer Support Team via our Contact Us Page.
Contacting Our Customer Support
If you reach out to our Customer Support team through our Contact Us Page, we will collect your email address and may track your IP address, along with any information you provide, to assist in resolving your issue. We will retain records of our communication, including any complaints you make about other users (and complaints from other users about you), for up to 7 years after your account is deleted.
Cookies and Similar Technologies
When you visit our site or use our app, we may automatically collect personal data through the use of cookies or similar technologies. A cookie is a small file placed on your device or browser that helps us recognize and remember you.
2. USE OF YOUR INFORMATION
Our main aim is to ensure that your experience on Cubbley Heart is enjoyable. To do this, we may use your registration and other details for the following purposes:
- To provide you with our services and features
- To send you updates and information about new features of the app
- To customize the app and the content shown to you
- To conduct research and analyze how you use the app
- To test new technologies and improvements for the app
- To address disputes, solve problems, and enforce our Terms & Conditions
- To investigate fraud, protect our legal rights, and enforce our Terms & Conditions
- To send you details about promotions and offers (such as goods, services, or discounts) if you’ve agreed to receive them. We will only send you marketing emails if you’ve opted in during account creation or through the app settings, and you can opt out at any time
- To safeguard our users and third parties from harm.
Our Matching Algorithms
Cubbley Heart’s goal is to foster kind and equitable connections. To help achieve this, we’ve created matching algorithms that predict compatibility between users, enabling us to show you people who we believe are a good fit for you. These algorithms consider various signals from your profile (such as how you interact with the app, including how you swipe or if you match with others, your answers to compatibility quizzes). By using these signals, we aim to recommend the most relevant profiles to increase your chances of making meaningful connections.
Our matching algorithms take into account several factors and use machine learning, compatibility quizzes to rank profiles, enhancing your chances of finding compatible matches. The data we use to assess your compatibility and generate profile suggestions includes information you provide in your profile (like age, distance, and gender), your app interactions (to suggest active users who are open to meeting new people), and your device location, which helps us understand your proximity to other users.
The legal basis for processing profile and location data is that it is necessary to provide our contractual services to you. For processing data related to your app activity, we rely on our legitimate interest in offering more personalized and relevant recommendations. If your profile contains sensitive information, such as details about your beliefs, we process this data based on your explicit consent.
Moderation Practices
At Cubbley Heart, we utilize both automated tools and a team of moderators to review user accounts, including photos and other information shared on profiles, as well as messages, to identify any content that may violate our Terms and Conditions. If an account or message is found to likely breach these terms, the account may receive a warning, and the user’s access may be limited or blocked. Users who are affected by such actions can reach out to Cubbley Heart to appeal the decision. If you share content that goes against our Terms and Conditions, we reserve the right to suspend or terminate your account.
3. INFORMATION DISCLOSURE
Our policy is to keep your Registration Information and personal data private, except in the specific situations outlined below:
- Service Providers – We work with trusted third parties to provide services for us. We may share your Registration Information or personal data with these parties, but only for the purpose of providing these services.
- Moderators – To help monitor activity and approve content within the app. This may include your name, registration details, profile information, message content, and photos.
- Payment Processing and Telecommunications Companies – To process payments for our premium services. This may include cardholder name, address, card number, payment amount, transaction date/time.
- Law and Harm – We take user behavior seriously on the app. We will cooperate with third parties to protect their rights and comply with law enforcement requests, including investigations into criminal activity or to protect someone’s vital interests. This may include any personal data we hold about you, depending on the situation. We may also disclose your information to comply with legal obligations or when it is necessary to:
– Follow court orders or lawful requests
– Protect someone’s safety
– Address fraud, security, or technical issues, including through anti-spam providers
– Protect our rights or those of third parties
- Business Transfers – In the event of a business change, such as a merger, acquisition, reorganization, or sale of assets, we may need to disclose your personal data. This may include all personal data we hold about you.
- Marketing Services Providers – To help with marketing, advertising on third-party platforms, and measuring the success of campaigns. This may include your advertising ID, estimated location (based on your IP address), age, gender, actions on our site/app (such as downloading or creating an account), hashed email address (for ‘custom audiences’).
- Anti-Spam and Anti-Fraud – Your data may be shared within the Cubbley Heart Group to prevent fraud, block suspicious accounts, and secure payments. This may include email address, phone number, IP address, session data, social network ID, username, user agent string, transaction, and payment details.
- Aggregated Information – We may share aggregated, non-identifiable data with third parties, which includes personal data alongside other information for industry analysis or demographic profiling.
4. WHAT OTHERS CAN VIEW ABOUT YOU
At Cubbley Heart, we have features to help you connect and engage with other users. When using Cubbley Heart, please keep in mind that anything you post or submit on the app might be visible to both users and non-users. We encourage our users to be mindful of the information they share, as it could eventually be made public.
Be cautious when sharing sensitive details on your profile, such as your religious beliefs or health information. You might also choose to provide sensitive data when adding certain badges to your profile, like your religion or political views. While you can voluntarily include this information, such as your sexual preferences, there is no obligation to do so. Remember, photos you upload can also reveal personal details. By uploading sensitive information or adding badges to your profile, you are giving explicit consent for us to process and potentially make that information public for other users to see.
Your Cubbley Heart profile, along with any other information you share through the app, may be accessible to other users and can even be shared with non-users. For example, someone might take a screenshot of your profile picture and share it with their Facebook friends, even if those friends are not using the app.
Additionally, in certain regions (currently South Korea), users can download a copy of their conversation history, as required by local laws. Please note that Cubbley Heart has no control over how this information might be used or shared once downloaded.
5. AGE
While we want as many people as possible to enjoy Cubbley Heart, you must be at least 18 years old to use the app. Cubbley Heart does not knowingly collect information from or target children, minors, or anyone under the age of 18. If we discover that a child, minor, or individual under 18 has registered and provided personal information, we will take immediate action to terminate their registration.
6. SECURITY
At Cubbley Heart, we are committed to implementing appropriate security measures to protect your information from loss, misuse, unauthorized access, or disclosure. We use reasonable security practices, such as secure servers and firewalls, to maintain the confidentiality of your personal data. However, it is important to note that no website or internet transmission can be fully secure, and we cannot guarantee that unauthorized access, hacking, data loss, or other breaches will never occur. That said, here are some helpful tips to keep your data secure:
- Always log out of your account when you’re finished, as you never know who might gain access to your device.
- Keep your Cubbley Heart account password private and don’t share it with anyone.
- Change your password regularly.
If you suspect someone may have accessed your account or password, follow the steps provided here. While we strive to protect your personal data, we cannot guarantee the security of information transmitted to our site, and any transmission is done at your own risk.
7. DATA RETENTION AND DELETION
We retain your personal information only for as long as necessary based on the legal grounds specified in Section 2 above and as allowed by applicable laws. When you delete your account, we ensure it is no longer visible within the app. However, for up to 360 days, you can restore your account if it was deleted by mistake. After 360 days, we begin the process of deleting your personal data from our systems, unless:
- We are required to keep it to comply with legal obligations (for example, if you’ve made purchases in the app, some personal information may be kept for tax or accounting reasons)
- We need to retain it to demonstrate our compliance with applicable law (for instance, if your account was blocked, we may keep relevant details and records of the behavior that led to the block for legal purposes or future inquiries)
- There is an ongoing issue, claim, or dispute that requires us to retain the information until it is resolved
- We need to keep the information for legitimate business reasons, such as fraud prevention and enhancing user security (for example, information may need to be kept to prevent a banned user from creating a new account).
Please note that even after you delete information from your profile or delete your account, copies of that information may still be accessible if it was shared with others or stored by others. We have no control over this and do not accept liability for such instances. If you’ve granted third-party apps or websites access to your personal data, they may retain it according to their own terms of service or privacy policies.
